Tranquility on the S. Newport

ARK appealed CMPC’s permit for a 1,394 foot Dock Rider System for Tranquility on the S. Newport. The CMPC approved this system after denying the permit for a conventional dock system based on the applicant’s assertion that the monorail system would reduce marsh shading. Evidence demonstrated that there was no scientifi c basis for the claims that the Dock Rider system would signifi cantly reduce impacts to the marsh including shading and marsh wrack accumulation. Stack & Associates represented ARK and uncovered signifi cant deficiencies in evaluating the permit during the trial. We are awaiting a fi nal decision from the court.
