This serves as notification from the Coastal Marshlands Protection Committee and the Georgia Department of Natural Resources of a request from CJ Tybee, LLC for a Coastal Marshlands Protection Act (CMPA) permit under Official Code of Georgia (O.C.G.A.) 12-5-280 et seq., to complete the construction of a community dock facility for the residents of Baisdens Bluff located on the Crescent River, McIntosh County, Georgia.

The applicant proposes to remove a grandfathered dock and replace it with a new structure in a similar footprint to serve as the Baisdens Bluff development community dock facility. The dock will consist of a 20' x 20' covered fixed deck, a 10' x 235' float connected by a 4' x 30' ramp. The dock structure will be connected to the upland by a 6' x 20' fixed walkway. The structure currently impacts approximately 1,518 square feet (0.03 acres). As proposed, the dock facility will impact approximately 3,350 square feet (0.07acres) of coastal marshlands.

The Crescent River is approximately 120' wide from Mean Low Water to Mean Low Water (MLW) at the dock location. As proposed, the structure will extend approximately 40 feet into the channel beyond MLW. The proposed dock facility will serve a 66-unit condominium complex. The applicant proposes to construct all drives and parking areas with pervious material. Wastewater will be treated by four septic tanks, one for each building. The effluent will go through three stages of filtration before being released via 8-inch deep drip lines into the landscaping of the upland parcel. All stormwater generated from the site will flow through a 10-20 ft wide vegetated swale, that will run along the drives and in between the four building units. The applicant is proposing a 50' buffer that will be hand trimmed for view.

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. Impacts to coastal marshlands must be minimal in size. In passing upon the application for permit, the Coastal Marshlands Protection Committee shall consider the public interest: (1) Whether or not unreasonably harmful obstruction to or alteration of the natural flow of navigational water within the affected area will arise as a result of the proposal; (2) Whether or not unreasonably harmful or increased erosion, shoaling of channels, or stagnant areas of water will be created; and (3) Whether or not the granting of a permit and the completion of the applicants proposal will unreasonably interfere with the conservation of fish, shrimp, oysters, crabs, clams, or other marine life, wildlife, or other resources, including but not limited to water and oxygen supply.
